Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Architects List (the “Service”), including any websites, pages, features, and content provided by Architects List (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

01Definitions

“User” means anyone who visits or uses the Service. “Account” means a registered user account. “Firm” means an architecture firm, designer, studio, or professional profile on the Service.

“Content” means any text, images, photographs, graphics, audio, video, data, listings, and other materials made available through the Service. “User Content” means any Content you submit, upload, import, link, post, or otherwise make available through the Service.

02The Service

Architects List is a city-based directory and showcase of residential architecture projects and firms. The Service helps Users discover projects and firms and may provide tools to follow firms, save projects, organize collections, and contact or request information from firms.

Architects List is not a party to any agreement between Users and firms (or any other third party). We do not guarantee that any firm will respond to inquiries, accept a project, or that any project outcome will meet expectations.

03Platform-Curated Profiles and Content

3.1 — Curated firm profiles

Architects List may create and publish firm profiles, project pages, and related content using publicly available information (including text, images, and project details found on a firm's own website or other public sources). These profiles are created in good faith to showcase and promote the firm's work and to help Users discover residential architecture professionals.

3.2 — Claiming and managing a profile

Firms may claim their profile on Architects List at any time. Once claimed, the firm gains full control over its profile and may add, edit, or remove projects, images, descriptions, and other content associated with it. Instructions for claiming a profile are available on the Service or by contacting us at mail@architectslist.com.

3.3 — Removal requests

If a firm or rights holder wishes to have a profile, project, or any specific content removed from the Service, they may contact us at mail@architectslist.com. We will respond to removal requests promptly.

3.4 — No endorsement or affiliation

The presence of a firm profile on the Service does not imply that the firm has endorsed, sponsored, or is affiliated with Architects List, unless the firm has claimed and actively manages its profile.

04Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an Account. By using the Service, you represent that you meet these requirements.

05Accounts and Registration

If you create an Account, you agree to:

  • Provide accurate, current information and keep it updated.
  • Maintain the confidentiality of your login credentials.
  • Promptly notify us of any unauthorized use of your Account.

We may suspend or terminate Accounts we believe are inaccurate, fraudulent, compromised, or used in violation of these Terms.

06Privacy and Communications

Your use of the Service is also subject to our Privacy Policy. By creating an Account, you consent to receiving Service-related communications (e.g., account messages, security notices, transactional emails). You may opt out of marketing emails at any time via the unsubscribe link (where applicable).

07Acceptable Use

You agree not to:

  • Violate any law or regulation.
  • Infringe, misappropriate, or violate intellectual property, privacy, or publicity rights.
  • Upload malware, spam, or harmful code.
  • Attempt to bypass security, probe, scan, or test vulnerabilities.
  • Scrape, crawl, harvest, or use automated means to access the Service except as expressly permitted by us in writing.
  • Reverse engineer or attempt to derive source code or underlying ideas from the Service.
  • Interfere with or disrupt the Service (including by abusive traffic, DDoS, or excessive requests).
  • Impersonate others or misrepresent your affiliation.

We may investigate and take any action we deem appropriate, including removing content or suspending accounts.

08User Content Standards

You are responsible for your User Content. You agree not to submit User Content that is unlawful, infringing, defamatory, deceptive, abusive, invasive of privacy, or otherwise harmful.

If you submit projects or photos, you agree to provide accurate information to the best of your ability, including (when known/required): architect/firm attribution, photographer credit, project location (at an appropriate level), and any other required credits.

09Copyright, Photography, and Intellectual Property

9.1 — Our intellectual property

The Service (including our branding, layout, design, code, and the selection/arrangement of content) is owned by Architects List or our licensors and is protected by intellectual property laws. Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, lease, or create derivative works from any portion of the Service.

9.2 — Third-party ownership

Many images and project materials shown on Architects List are owned by third parties (including architects, photographers, designers, and licensors). Display of such content does not transfer ownership rights to you.

9.3 — Limited license to users

We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Service for personal, informational, and non-commercial use. Except through the Service's normal sharing features (e.g., sharing a link), you may not download, reproduce, distribute, publicly display, publish, or commercially exploit any photos or other content without permission from the applicable rights holder.

9.4 — Your representations and warranties

If you submit, upload, import, link, or otherwise provide User Content (including photographs), you represent and warrant that:

  • You own the User Content or have obtained all necessary rights, licenses, consents, and permissions to use it and to grant the licenses in these Terms (including permissions from photographers and any other rights holders);
  • Your User Content does not infringe or violate any third-party rights (copyright, trademark, publicity/privacy, contract restrictions, etc.); and
  • Your User Content is accurate to the best of your knowledge, including credits/attributions you provide.

9.5 — License you grant to Architects List

By providing User Content, you grant Architects List a worldwide, non-exclusive, royalty-free, fully paid, transferable, sublicensable license to host, store, reproduce, cache, display, publish, distribute, transmit, publicly perform, and create derivative works of that User Content solely as necessary to operate, improve, and promote the Service. This includes (without limitation) formatting, resizing, cropping, compressing, making thumbnails, and using User Content in marketing/promotional placements (e.g., featured projects, newsletters, social posts, and city/firm pages), with attribution where reasonably practical.

This license continues as long as your User Content remains on the Service and for a commercially reasonable period after removal for backup, archival, and legal compliance purposes.

9.6 — Credits and attribution

We may display photographer and other credits where provided or reasonably available. You are responsible for providing accurate credit information and any required attribution language. We may standardize formatting and placement of credits and cannot guarantee that any specific attribution will appear in every context (e.g., thumbnails, embeds, previews).

9.7 — No duty to pre-screen; removal rights

We do not verify that every item of User Content has complete rights clearance. We reserve the right (but have no obligation) to monitor, remove, disable access to, or edit any content at any time, including upon receiving complaints or if we suspect infringement or violations of these Terms.

10Copyright Complaints (DMCA) and Repeat Infringers

10.1 — DMCA notices

If you believe content on the Service infringes your copyright, you may submit a takedown notice to mail@architectslist.com. We will respond to valid notices consistent with applicable law. Your notice should include:

  • Identification of the copyrighted work claimed to be infringed;
  • Identification of the material claimed to be infringing and information reasonably sufficient to locate it (URL);
  • Your contact information;
  • A statement that you have a good-faith belief the use is not authorized;
  • A statement under penalty of perjury that your notice is accurate and you are authorized to act; and
  • Your physical or electronic signature.

10.2 — Counter-notices

If your content was removed due to a copyright notice and you believe it was removed in error, you may send a counter-notice to the DMCA Agent. We may restore the content as permitted by law.

10.3 — Repeat infringers

We may terminate Accounts of Users who are repeat infringers in appropriate circumstances.

11Third-Party Links, Integrations, and External Content

The Service may contain links to third-party sites or services. We do not control and are not responsible for third-party content, policies, availability, or practices. Your dealings with third parties are between you and the third party.

12Following, Saved Projects, Feeds, and Notifications

The Service may let you follow firms, save projects, create folders/collections, and view feeds or updates. We may change how feeds, saved projects, and follows work (including ordering, freshness windows, and visibility) at any time. We do not guarantee that feeds or notifications will be delivered, timely, or error-free.

13Feedback

If you provide suggestions, ideas, or feedback, you grant Architects List a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate that feedback without compensation or credit.

14Termination

We may suspend or terminate your Account or access to the Service at any time if we believe you violated these Terms, infringed rights, created risk for the Service, or for any other reason in our discretion. You may stop using the Service at any time.

Upon termination, sections that by their nature should survive will survive, including (without limitation) intellectual property, licenses, disclaimers, limitation of liability, indemnity, and dispute provisions.

15Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCHITECTS LIST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Architects List does not guarantee:

  • the accuracy, completeness, or rights clearance of any content;
  • that any firm will respond to an inquiry or accept a project;
  • that the Service will be uninterrupted, secure, or error-free.

Architects List is not an architecture, engineering, legal, financial, or construction advisor. Any information on the Service is for general informational purposes only.

16Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCHITECTS LIST WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCHITECTS LIST'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID ARCHITECTS LIST IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

17Indemnification

You agree to defend, indemnify, and hold harmless Architects List, its affiliates, and their owners, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • your access to or use of the Service;
  • your User Content (including any claim that your User Content infringes or misappropriates copyright, trademark, publicity, or privacy rights);
  • your violation of these Terms; or
  • your dealings with any third party through the Service.

18Governing Law and Venue

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. You agree that any disputes will be brought exclusively in the state or federal courts located in the City and County of Denver, Colorado, and you consent to personal jurisdiction and venue there.

19Changes to These Terms

We may update these Terms from time to time by posting a revised version and updating the Effective Date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

20Miscellaneous

Entire Agreement: These Terms (and any policies referenced) are the entire agreement between you and Architects List regarding the Service.

Severability: If any provision is unenforceable, the remaining provisions remain in effect.

No Waiver: Failure to enforce a provision is not a waiver.

Assignment: You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

Electronic Communications: You consent to receiving communications electronically.
